Where the 8.875% comes from
The standard New York City sales and use tax combines a 4.5% New York City rate, 4% New York State rate and 0.375% Metropolitan Commuter Transportation District surcharge.
That combined 8.875% rate applies to many ordinary taxable retail purchases such as electronics and other tangible personal property.
Eligible clothing and footwear under $110 are different
NYC Department of Finance states that clothing and footwear under $110 are exempt from New York City and New York State sales tax. New York State guidance explains that the test is applied to each item or pair.
Two shirts can each qualify for the exemption even when their combined receipt total is above $110, as long as each item individually remains below the threshold and qualifies as exempt clothing.
Not everything worn on the body counts as exempt clothing
New York State lists categories such as jewelry, watches, protective equipment and some sporting equipment outside the ordinary clothing exemption. A wearable item is not automatically treated as exempt clothing for sales-tax purposes.
